Purpose and Scope of Application

These General Contracting Conditions regulate the contractual relationship between Luz Karime Posada (hereinafter, "the Seller") and the user who purchases products or services through the website https://detoxforsuccess.com (hereinafter, "the Client").

The express acceptance of these conditions is an essential requirement to complete any purchase process. The Client declares to be over 18 years of age and to have full legal capacity to contract. The use of the website and the contracting of services implies full acceptance of these conditions.

These conditions will apply to all purchases made through the website, complementing the Legal Notice and the Privacy Policy, documents that the Client declares to have read and accepted.

The Seller reserves the right to modify these conditions at any time. The modifications will be applicable from their publication on the website and will not affect contracts already finalized.

Physical publications and printed materials with home delivery within the timeframes indicated for each product.

In case of discrepancy between the description and these general conditions, the specific conditions of the product or service shall prevail.

Purchasing Process

The purchasing process through the website is carried out in the following steps:

  • Product or service selection: the Client selects the desired product or service and adds it to the shopping cart or accesses the contracting form directly.
  • Billing data: the Client provides their personal and billing data necessary to process the order.
  • Order review: the Client reviews the order summary, including the selected products, the total price, and applicable taxes.
  • Acceptance of conditions: the Client checks the box accepting these Contracting Conditions and the Privacy Policy, a mandatory and indispensable step to continue.
  • Payment: the Client selects the payment method and completes the transaction through the secure payment gateway.
  • Confirmation: once the payment is successfully processed, the Client receives an order confirmation email with the purchase summary and instructions to access the service.
Perfection of the contract: The contract is deemed finalized at the moment the Seller sends the order confirmation by email. The Seller reserves the right to reject or cancel orders in justified cases (pricing error, lack of availability, signs of fraud, etc.), proceeding in such cases to fully refund the amount paid.

Prices and Taxes

The prices of the products and services offered on the website are expressed in euros (€) and are those in effect at the time the order is placed.

VAT and taxes
The indicated prices include VAT and other applicable taxes when expressly stated. Different tax conditions may apply to clients outside the EU.
Price modification
The Seller reserves the right to modify prices at any time. Changes will not affect orders already confirmed and paid for.
Pricing errors
In the event of a manifest error in the published price, the Seller will contact the Client before processing the order to confirm the correct price or cancel the purchase with a full refund.
Billing
The Client will receive an invoice or purchase receipt by email after payment confirmation. For invoices with specific tax details, these must be provided during the purchasing process.
Promotions and discounts
Offers, promotions, and discounts are valid only during the indicated period and are not cumulative unless expressly stated otherwise.

Payment Methods

Right of Withdrawal

In accordance with Article 102 and following of Royal Legislative Decree 1/2007 (LGDCU), the consumer Client has the right to withdraw from the contract within a period of 14 calendar days from the date of contracting, without the need for justification and without any penalty.

Exceptions to the right of withdrawal

According to Article 103 of the LGDCU, the right of withdrawal shall not apply in the following cases:

  • Digital content: digital products (online courses, e-books, downloadable materials) whose download or access has begun with the Client's prior express consent and their knowledge that they thereby lose their right of withdrawal.
  • Executed services: services fully executed with the Client's consent before the end of the withdrawal period.
  • Mentoring sessions held: individual or group sessions already held on the date the withdrawal is requested.
  • Events and workshops: tickets for events, workshops, or seminars with a specific date, once that date has passed.

How to exercise the right of withdrawal

To exercise the right of withdrawal, the Client must communicate it by an unequivocal written statement addressed to the email info@detoxparaelexito.com with the subject "Withdrawal — Order No.", indicating the order number, the contracted product or service, and the date of purchase.

Refund timeframe: In case of a valid withdrawal, the Seller will proceed to fully refund the amount paid within a maximum period of 14 calendar days from the receipt of the communication, using the same payment method used by the Client.

Returns and Refunds

Regardless of the legal right of withdrawal, the return policy for each product or service is expressly stated in its sales listing. In general, the following conditions will apply:

Physical products
Returns are accepted within 14 days of receipt, provided the product is in perfect condition and in its original packaging. Return shipping costs are borne by the Client unless the product is defective.
Online courses and training
These are governed by the specific conditions indicated in each course. Generally, returns are not accepted once access to the content has begun, except in the case of a technical error attributable to the Seller.
Mentoring sessions
Sessions not held can be rescheduled with a minimum of 48 hours' notice. Cancellations with less than 24 hours' notice will not be eligible for a refund.
Digital content
Returns are not accepted once the digital content has been downloaded or accessed, in accordance with Article 103.m of the LGDCU.
Events and workshops
Cancellation and refund conditions are specified in each event's listing. Cancellation of the event due to causes attributable to the Seller will entitle the Client to a full refund.

To request a return, the Client must contact the Seller at info@detoxparaelexito.com indicating the order number and the reason for the return.

Access to Digital Content

For products and services in digital format, access will be provided subject to the following conditions:

  • Immediate access: digital content (courses, e-books, downloadable materials) will be available to the Client immediately after payment confirmation, via a link or access to the designated platform.
  • Access period: the access period for the content is indicated in the product description. Unless otherwise stated, access to online courses has a minimum duration of 12 months from the date of purchase.
  • Personal use: the purchased digital content is for strictly personal and non-transferable use. Its reproduction, distribution, public communication, or making available to third parties without the express authorization of the Seller is expressly prohibited.
  • Technical requirements: the Client is responsible for having the necessary technical means (device, internet connection, compatible software) to access the purchased digital content.
Intellectual Property: All digital content is protected by intellectual property rights. Unauthorized use may give rise to corresponding legal action under the Intellectual Property Law (Royal Legislative Decree 1/1996).

Responsibility and Guarantees

The Seller guarantees that the products and services offered conform to the description published on the website and are provided with due professional diligence. However, the following limitations of liability are established:

  • The results obtained by the Client as a consequence of applying the acquired knowledge depend exclusively on the Client's effort, dedication, and personal circumstances. The Seller does not guarantee specific economic results.
  • The Seller shall not be liable for indirect damages, loss of profit, or loss of opportunities arising from the use or inability to use the contracted products or services.
  • In the event of a breach attributable to the Seller, the maximum liability shall be limited to the amount paid by the Client for the affected product or service.
  • The Seller shall not be responsible for service interruptions due to force majeure, failures of third-party providers, or scheduled maintenance, provided they are communicated sufficiently in advance.

The personal data provided by the Client during the purchasing process will be processed in accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD), for the purpose of managing the contractual relationship, processing the payment, and sending the necessary communications related to the order.

Applicable Law and Jurisdiction

These General Contracting Conditions are governed by current Spanish legislation, with the following regulations applying, among others:

  • Law 34/2002 — Information Society Services and Electronic Commerce (LSSICE).
  • Law 7/1998 — General Contracting Conditions.
  • Regulation (EU) 2016/679 — Personal Data Protection (GDPR).
  • Royal Legislative Decree 1/1996 — Intellectual Property Law.

For the resolution of controversies, the parties submit to the competent Courts and Tribunals of Spain. However, if the Client has the status of a consumer, they may apply to the courts of their domicile in accordance with consumer protection regulations.

Contact and Complaints

For any query, incident, or complaint related to the contracting or the services purchased, the Client can contact the Seller through the following means:

The Seller commits to providing a response within a maximum period of 10 business days from the receipt of the complaint.

Consumer Arbitration System: If a satisfactory agreement is not reached, the consumer Client can turn to the Consumer Arbitration System of their Autonomous Community or the National Consumer Arbitration Board, an extrajudicial dispute resolution system, free for the consumer, to which the Seller agrees to submit provided the claim falls within its competence.
